Terms of Service | Service Agreement

These Terms of Service (“Agreement”) govern the use of services provided by Farm 6 Hosting (“Provider,” “we,” “us”) to you (“Client,” “you”). By signing up for our services, you agree to these terms.

1. Service Description

Farm 6 Hosting provides managed web hosting and related services. While we aim for 100% uptime, we cannot guarantee that our service will be uninterrupted or error-free due to the nature of the internet and hardware.

2. Your Responsibilities

• Account Security: You are responsible for keeping your billing password and account details secure.
• Content: You retain full ownership of your website content. You agree not to host content that is illegal in Canada, including but not limited to: malware, phishing sites, pirated software, or hate speech.
• Backups: While we perform daily server backups for disaster recovery, you are ultimately responsible for your own data. We recommend keeping a local copy of your website files. F6M Hosting is not liable for data loss caused by user error, plugin malfunctions, or malicious attacks.

3. Payments & Renewal

• Automatic Renewal: Services will automatically renew (monthly or annually) using the payment method on file unless cancelled 24 hours prior to the due date.
• Late Payments: Invoices are due upon receipt. Accounts more than 7 days overdue may be temporarily suspended. Accounts more than 30 days overdue may be terminated and data removed from our servers.

4. Acceptable Use Policy (AUP)

To ensure high performance for all clients on our servers, you agree not to:

• Send unsolicited bulk email (Spam).
• Run high-load scripts (like crypto miners) that degrade server performance for others.
• Use your hosting space strictly for file storage/archiving (outside of website operations).

We reserve the right to throttle or suspend sites that violate this policy to protect other users.

5. Limitation of Liability (The Important Part)

• Indemnification: You agree to indemnify and hold harmless F6M Hosting from any claims resulting from the use of our service which damages you or any other party.
• Maximum Liability: In no event shall F6M Hosting’s liability exceed the total amount paid by the Client for the specific service in the one (1) month prior to the incident. We are not liable for lost profits, lost business, or lost data.

6. Governing Law

This agreement shall be governed by the laws of the Province of Ontario and the laws of Canada applicable therein.

7. Copyright & Abuse (Notice and Notice)

F6M Hosting complies with the Canadian Copyright Act “Notice and Notice” regime.

• Reporting Abuse: If you believe a site hosted on our servers violates your copyright, please submit a notice to info@farm6.net.
• Action: Upon receiving a valid notice, we will forward it to the responsible client. We reserve the right to suspend services for repeat offenders or for content that clearly violates our Acceptable Use Policy, regardless of court status.
