As a Canadian web hosting provider, we comply with the Copyright Modernization Act (Notice and Notice regime) and voluntarily align with global best practices regarding the Digital Millennium Copyright Act (DMCA).
If you believe that content hosted on our servers infringes your copyright, please follow the procedure below.
1. Our Role as an Intermediary
Farm 6 Hosting acts as a storage provider. We do not create, modify, or actively monitor the content uploaded by our clients. However, per our Terms of Service, we strictly prohibit the use of our infrastructure for hosting illegal content, including pirated software, movies, music, or other unauthorized copyrighted material.
2. Reporting Copyright Infringement
To file a complaint, please use the DMCA / Abuse Report Form [Link to your Form] located on this page.
For your notice to be effective and actionable, it must include the following details:
- Identification of the Work: A description of the copyrighted work you claim has been infringed.
- Location of Infringement: The specific URL(s) where the infringing material is located. (Sending a generic domain name is not sufficient; we need the exact links).
- Your Contact Information: Name, address, telephone number, and email address.
- Statement of Good Faith: A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
- Signature: A physical or electronic signature of the copyright owner or authorized representative.
3. Our Response Procedure (Notice and Notice)
Upon receiving a valid complaint, Farm 6 Hosting will take the following steps in compliance with Canadian law:
- Verification: We will review the notice to ensure it meets the formatting requirements and pertains to a site actively hosted on our IP space.
- Forwarding: We will forward the full notice (including your contact details) electronically to the customer responsible for the content.
- Record Keeping: We will retain a record of the notice for a minimum of six months, as required by law.
4. Account Suspension & Takedowns
While Canadian law imposes a “forwarding” obligation, Farm 6 Hosting reserves the right to disable access to infringing material or terminate the accounts of repeat offenders under our Acceptable Use Policy (AUP). If a client fails to respond to a copyright notice or verify their rights to the content within a reasonable timeframe, we may suspend the service to protect our network reputation and legal standing.
5. Counter-Notices
If you are a client of F6M Hosting and believe your content was flagged in error, you may submit a Counter-Notice via the Support Ticket system. Your Counter-Notice must include:
- Your contact information.
- Identification of the material that was removed or disabled.
- A statement under penalty of perjury that you have a good faith belief the material was removed due to mistake or misidentification.
